DONKEYBYTE SRL provides digital services including but not limited to:

Website design
Website development
Graphic design
Branding and digital design services
Website optimization and consultation
Post-launch website maintenance, available at an additional cost upon request

Service specifications, pricing, and timelines may vary depending on project requirements.
All services are provided subject to a mutually agreed quotation or contract.

4. Eligibility

Our services may only be ordered by individuals who are at least 18 years old and have full legal capacity to enter into contracts, or by legally registered businesses acting through an authorized representative.
Individuals under 18 may only use our services through a parent or legal guardian, who shall be considered the contracting party and shall be responsible for all obligations under these Terms and Conditions.

5. Quotes and Payments

Quotes provided through the website or by email are non-binding until formally accepted by both parties.
Accepted payment methods include:

Bank transfer
Revolut Business transfer
Card payment via Netopia (available through a secure payment link on the invoice)

Payment terms may include upfront deposits, milestone payments, or full payment upon project completion, as agreed in the individual quotation or contract.
Failure to make payments may result in suspension of services or delayed delivery.
All prices are stated in EUR or RON unless otherwise specified.

6. Right of Withdrawal (Consumers)

If you are a consumer (an individual acting outside of a trade, business, or profession) and you order services through this website or by email, you have the right to withdraw from the contract within 14 calendar days without giving any reason, in accordance with OUG 34/2014 and EU Directive 2011/83.

However, given the nature of custom design and development work, the following applies:

If you expressly request that we begin work before the end of the 14-day withdrawal period, and you acknowledge that you will lose your right of withdrawal once the service has been fully performed, your withdrawal right will end as soon as the service is fully delivered.
If you withdraw from the contract after work has begun but before the service is fully delivered, you agree to pay an amount proportional to the services already provided, calculated in relation to the total price agreed in the quotation or contract, up to the date you notified us of your withdrawal.

To exercise your right of withdrawal, please notify us in writing at hello@donkeybyte.com before work begins, or before the service is fully delivered, whichever applies.

This section does not apply to clients acting as businesses or professionals, for whom cancellation terms are governed by the individually agreed quotation or contract.

7. Client Responsibilities

Clients agree to:

Provide accurate information
Provide required content (text, images, branding assets)
Review and approve project milestones in a timely manner

Delays in client communication may affect project timelines and delivery dates.

8. Intellectual Property

Unless otherwise agreed:

DONKEYBYTE SRL retains ownership of design drafts, concepts, and unused materials.
Upon full payment, the client receives usage rights to the final approved design or website deliverables.

Third-party resources such as fonts, plugins, images, or software licenses may be subject to their respective licensing terms.

9. Limitation of Liability

DONKEYBYTE SRL shall not be held liable for:

Indirect or consequential damages
Loss of business, profits, or data
Downtime caused by third-party services (hosting providers, software platforms, etc.)

Our liability is limited to the amount paid for the specific service.

10. Website Usage

Users agree not to:

Attempt unauthorized access to the website
Interfere with website functionality
Use the website for unlawful purposes

We reserve the right to restrict access to users who violate these terms.
